1. Acceptance of Terms
By downloading, accessing or using the PicoStep application (the "App") or this website (the "Site"), you agree to be bound by these Terms of Service ("Terms") and, where the App is obtained from the Apple App Store, the Apple Standard Licensed Application End User License Agreement (EULA) available at apple.com/legal/internet-services/itunes/dev/stdeula, which is incorporated herein by reference. If you do not agree, do not use the App or Site.
2. Description of the Service
PicoStep is a productivity application that helps users break down overwhelming tasks into micro-steps ("defragmentation"), provides a focus timer with Live Activities, and stores tasks locally on the user's device. The Service is provided for personal, non-commercial use.
3. Eligibility and Accounts
You must be at least 13 years old (or the minimum digital-consent age in your country, if higher) to use the App. You are responsible for maintaining the confidentiality of your Apple ID and for all activity under your account. Sign in with Apple is used for authentication; you must not create an account using false information or another person's identity.
4. Subscriptions, Free Trial, Billing and Cancellation
- PicoStep Pro is offered as an auto-renewing subscription: USD 6.99/month or USD 49.99/year, or the equivalent price in your local currency as displayed in the App Store at the time of purchase.
- 7-day free trial — where offered, one trial per Apple ID. Unless cancelled at least 24 hours before the end of the trial period in your Apple ID settings, the trial converts automatically into a paid subscription.
- Billing and renewal — payment is charged to your Apple ID at confirmation of purchase; the subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your App Store account settings.
- Refunds — all purchases and refunds are handled exclusively by Apple in accordance with App Store policies. We cannot issue refunds directly.
- Prices include applicable VAT where required. Apple may change store pricing; changes apply on renewal with prior notice through the App Store.
5. Licence and Acceptable Use
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices that you own or control, as permitted by the Apple EULA and these Terms. You agree NOT to: reverse-engineer the App except where such restriction is prohibited by law; resell, rent or commercially exploit the Service; interfere with or disrupt the Service or its infrastructure; upload unlawful, infringing or malicious content; or use the Service to violate any applicable law or third-party right.
6. Intellectual Property
The App, the Site, the PicoStep name, logo and all related content are owned by FerrisTech Marcin Miłoszewski and protected by copyright and trademark law. You retain all rights to the content you create with the App. Nothing in these Terms transfers ownership to you.
7. No Medical Advice
PicoStep is a productivity tool only. It is not a medical device and does not provide medical, psychological or psychiatric advice, diagnosis or treatment, and is not a substitute for professional care. Always seek the advice of a qualified health provider with any questions regarding a medical condition, including ADHD.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, except as expressly stated or mandated by law. We do not warrant that the Service will be uninterrupted, error-free or that AI-generated suggestions will always be accurate or suitable for your purposes. You are responsible for reviewing generated steps before acting on them.
9. Limitation of Liability
To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to the Service is limited to the greater of: (a) the amount you paid to us for the Service in the 12 months preceding the claim, or (b) USD 50. We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill.
Consumer protection carve-out: nothing in these Terms limits or excludes liability where doing so is prohibited by mandatory law — including, for consumers in the EU/UK, liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for wilful misconduct or gross negligence, or any other liability that cannot lawfully be excluded.
10. Consumer Rights (EU/EEA/UK)
If you are a consumer, you benefit from all mandatory protections of the law of your country of residence, including the statutory right of withdrawal for digital content and from the EULA's minimum protections, which always prevail over these Terms where more favourable to you. These Terms do not affect your statutory rights.
11. Termination
You may stop using the Service and delete your account at any time (via "Delete Account" in the App or by e-mail). We may suspend or terminate your access if you materially breach these Terms, unlawful conduct is involved, or where required by law — with notice where practicable. Sections 6–10 and 13–15 survive termination.
12. Third-Party Services
The Service relies on Apple (App Store, Sign in with Apple, Speech Recognition, In-App Purchases), RevenueCat (subscription management) and Supabase (cloud infrastructure). Your use of these third-party services is additionally governed by their respective terms. We are not responsible for third-party services, but we select them with care and require reasonable security standards.
13. Changes to the Service or Terms
We may modify the Service or these Terms. If a change is material and adversely affects you, we will provide reasonable advance notice (e.g., in-App or on the Site). Continued use after the effective date constitutes acceptance; if you do not agree, you may cancel your subscription and stop using the Service.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Any dispute shall be resolved before the courts of Toruń, Poland — provided that consumers may also bring proceedings in the courts of their place of residence under mandatory consumer-protection law, and EU consumers may use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr) where applicable.
